1. About these terms

These Terms & Conditions (“Terms”) govern your use of Upshyft websites, company and admin portals, and the worker mobile application (together, the “Platform”). Upshyft provides a labour marketplace that connects companies seeking short-term or shift-based workers with individual workers seeking that work.

This page is provided as generic sample content for marketing and demonstration purposes. It is not legal advice. Replace it with counsel-reviewed terms before going live.

2. Who may use Upshyft

  • You must be legally able to enter a binding agreement in your jurisdiction.
  • Companies must provide accurate business details and complete any required verification or approval steps.
  • Workers must provide accurate personal details and complete identity verification where required before accepting jobs.
  • You are responsible for keeping login credentials confidential and for activity under your account.

3. Accounts and roles

Access to certain features depends on your role (for example company staff, worker, or Upshyft admin) and the permissions assigned to that role. You agree not to attempt to access areas of the Platform that you are not authorised to use.

4. Jobs, hiring, and attendance

Companies may post job opportunities and review applications or invitations. Workers may browse, apply for, or accept jobs subject to platform rules and approval status. Attendance confirmation (including one-time codes or similar checks) may be required to start or end a shift. You agree to use attendance features honestly and only for legitimate job activity.

5. Payments, holds, and withdrawals

Where payments are processed through Upshyft, funds related to a job may be held until work is verified and the job is closed according to platform rules. Worker earnings may be released to an in-app wallet and withdrawn subject to applicable checks, fees, and payout provider rules. Refunds for unused or unworked days may be requested by companies and reviewed under platform policy.

You are responsible for any taxes applicable to your activity. Commission, tax line items, and fees will be shown in the Platform where applicable.

6. Acceptable use

You agree not to:

  • Misrepresent your identity, company, skills, or work performed
  • Harass, discriminate against, or exploit other users
  • Circumvent payment, verification, or security controls
  • Upload unlawful, harmful, or infringing content
  • Attempt to reverse engineer, disrupt, or overload the Platform
  • Use the Platform for any purpose that violates applicable law

7. Intellectual property

Upshyft and its licensors own the Platform, branding, and related materials. You receive a limited, non-exclusive, non-transferable right to use the Platform for its intended purpose. You retain ownership of content you submit, and grant Upshyft a licence to host and process that content as needed to operate the service.

8. Disclaimers

The Platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Upshyft does not guarantee uninterrupted availability, that every hire will succeed, or that every user will complete every obligation. Marketplace outcomes depend on the conduct of companies and workers.

9. Limitation of liability

To the maximum extent permitted by law, Upshyft is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Platform. Nothing in these Terms excludes liability that cannot be limited under applicable law.

10. Suspension and termination

We may suspend or terminate access if you breach these Terms, fail verification, pose a risk to other users, or if required by law or payment partners. You may stop using the Platform at any time. Provisions that by nature should survive (including intellectual property, disclaimers, and liability limits) will continue to apply.

11. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Platform after updates means you accept the revised Terms, except where local law requires a different process.
